The following conditions apply to the delivery and installation of equipment and systems of IMHOTEC Engineering AG, unless other or deviating agreements have been formulated and confirmed in writing by IMHOTEC Engineering AG.
The General Terms and Conditions of IMHOTEC Next Level Safes
The following conditions apply to the delivery and installation of equipment and systems of IMHOTEC Engineering AG, unless other or deviating agreements have been formulated and confirmed in writing by IMHOTEC Engineering AG.
All our prices are quoted in CHF plus VAT and, if applicable, shipping costs.
If labor or material costs change between the time of conclusion of the contract and the contractual delivery, we reserve the right to adjust prices.
Offers are binding and valid until the date stated on the offer. Thereafter they are subject to change. Directed work and unforeseen additional work caused by the customer will be carried out at the actual cost of CHF 179 per hour. Travel expenses will be charged additionally at CHF 1.75 per kilometer.
By accepting the order and sending the order confirmation or by concluding a written contract with the customer, IMHOTEC Engineering AG undertakes to provide and the customer undertakes to accept the service. In the event of cancellation of an order, the customer undertakes, subject to further claims, to compensate IMHOTEC Engineering AG with 50% of the agreed price for expenses and loss of profit. If an order is canceled later than 30 days before the agreed delivery date, the full price must be paid. Material that has already been produced and/or delivered must be paid for in full, irrespective of the time of cancellation.
IMHOTEC Engineering AG endeavors to meet the specified deadlines. However, delays on the part of the customer may make it difficult or impossible to meet the agreed deadlines. IMHOTEC Engineering AG shall not be liable for the consequences arising from such delays. Additional working hours or other additional costs incurred by IMHOTEC Engineering AG as a result will be charged by IMHOTEC Engineering AG after prior notification to the customer.
Installation dates specified in the order confirmation are binding. The working hours of IMHOTEC Engineering AG are between 08.00 in the morning and 17.00 in the evening. During this time, IMHOTEC Engineering AG must be granted access to the property. In addition, the customer is obliged to accept the installation during this time and to take part in the instruction.
If the customer is in default of acceptance, IMHOTEC Engineering AG has the right to waive the provision of the service, to withdraw from the contract and/or to claim the resulting damages.
The customer may postpone the installation date free of charge up to 5 working days before the agreed date. IMHOTEC reserves the right to charge a lump-sum fee of CHF 500 for rescheduling at shorter notice.
Failure to meet the deadline does not entitle the customer to claim compensation.
The systems installed by IMHOTEC Engineering AG are commissioned by IMHOTEC Engineering AG. This includes a functional check and detailed customer instructions. Commissioning also includes the integration of the system into the local network (LAN) and the mobile network as well as the installation of the application or user software (APP) on a stationary and mobile device, computer or smartphone, depending on the system and if available. The client or customer shall ensure that the network (LAN) is functioning properly on the day of installation, that the mains power supply is available and that the necessary access data for the router is available.
IMHOTEC Engineering AG is not authorized to make configuration adjustments to customer networks; if such adjustments are necessary for the integration of the systems supplied by IMHOTEC Engineering AG, the client or the customer is responsible for ensuring that an appropriately authorized and technically experienced person is either on site on the day of integration or can make the necessary adjustments remotely if required. Additional expenses arising from non-compliance with these instructions will be charged separately. The availability of mobile telephone networks cannot be guaranteed by IMHOTEC Engineering AG, which is why IMHOTEC Engineering AG assumes no responsibility for limited functions in the event of non-existent or weak/unstable mobile telephone networks. The same applies to unstable or below-average speed networks.
The customer has the option of concluding a maintenance contract with IMHOTEC Engineering AG.
The scope of services varies depending on the maintenance level.
Without a corresponding maintenance contract, the following services are available to you free of charge in the event of a fault in your system:
Technical telephone support, weekdays from 8 a.m. to 5 p.m.
Response time (callback): within 8 hours of receipt of the message
Remote support, if possible
Maintaining customer master data
Generally excluded from this free support are all operating errors and:
Recovering passwords
Support for installing apps and programs on mobile devices and PCs
Evaluating video files and logs
Operator training on the phone
Diagnosis of network errors or similar
IMHOTEC Engineering AG grants the manufacturer’s warranty of the respective product manufacturer on the products it installs. This warranty is limited to 2 years after completion of the order, unless otherwise agreed in writing. The warranty for product defects is limited to the right to replacement delivery. There are no other rights in respect of defects.
IMHOTEC Engineering AG does not assume any warranty for normal wear and tear or the consequences of improper handling, damage or repairs by the customer or third parties. IMHOTEC Engineering AG may refuse to honor the warranty if the equipment and/or system has not been properly maintained.
IMHOTEC Engineering AG grants a warranty of 2 years on the work performed by it. The warranty for defects in the execution of work is limited to rectification. There are no other warranty rights.
The forfeiture periods also apply to hidden defects.
The customer must immediately notify IMHOTEC Engineering AG in writing of any defects in the system delivered and/or installed by IMHOTEC Engineering AG.
Services that are not included in the offer or order confirmation will be invoiced additionally at the current rate on the date of execution. The responsibility for the coordination of the various companies involved in the overall construction lies with the client or the construction management, unless expressly agreed otherwise. Additional expenses incurred by IMHOTEC Engineering AG, which were caused by third-party companies as a result of non-compliance with execution instructions, will be invoiced separately. Unplanned work interruptions and hindrances that are not the responsibility of IMHOTEC Engineering AG, as well as the resulting expenses, expenses and travel time will be charged separately.
Unless expressly agreed otherwise, the following conditions apply: 30 days net or 2% discount for cash payment or payment within 10 days.
The invoice is due as soon as the ordered material has been delivered and installed. Possible change requests and additional deliveries, as well as postponements as explained under point 5. deadlines, do not release the customer from his obligation to pay the invoice on time.
IMHOTEC Engineering AG reserves the right to demand a down payment of 50% when the order is placed.
For projects which are carried out in several stages, the terms of payment are as follows.
30% when the order is placed
60% after delivery
10% after acceptance
If the customer does not meet the agreed payment deadlines, he shall be in default from the due date without a reminder. If the customer is in default of payment, IMHOTEC Engineering AG reserves the right to provide future services only against advance payment or cash on delivery. IMHOTEC Engineering AG charges 5% p.a. interest on arrears from the date of default.
IMHOTEC Engineering AG is entitled to charge a reminder fee in the amount of CHF 50. CHF.
The customer may not object to IMHOTEC Engineering AG’s defense of set-off due to improper performance or other alleged counterclaims.
IMHOTEC Engineering AG remains the owner of the delivery until full payment has been made in accordance with the contract. The customer undertakes to take the necessary measures to ensure that this ownership claim is neither impaired nor canceled.
The place of jurisdiction is the competent court at the registered office of IMHOTEC Engineering AG.
Swiss law shall apply, to the exclusion of international agreements.
